SPCC Compliance Update

After several years of planning, review and comment, the U.S. Environmental Protection Agency (EPA) has published new amendments to the rules affecting industries' compliance responsibilities under the Spill Prevention, Control and Countermeasures Plans (SPCC) (40 CFR 112, et seq).

Several years ago, Cooperatives developed SPCC Plans pursuant to the 2002 amendments to the Rules which established the requirement for such a Plan.  In 2006, an additional set of amendments to the Rules were developed, which, in large part, streamlined the SPCC planning process, created new exemptions for industry segments (which affect electric cooperatives), and defined Qualified Facilities which would be able to take advantage of a fast-track self-certification process.  These "new" amendments were recently published in and will have an effective date of January 14, 2010. Cooperatives have until November 10, 2010 to amend or prepare SPCC plans to bring them into compliance with the 2002 rules and the Phase II amendments.

Presently, Schneider Engineering (SE) is assisting our Clients manage their SPCC compliance requirements in the following specific areas: 

  • Develop new SPCC plans
  • Perform five-year SPCC plan review and updates
  • Perform annual Spill Prevention staff briefings
  • Develop Self-Certification documents
  • Design and construction of secondary containment structures for new substation, new facility and existing substation projects
